ORDER

The relief sought for in this writ petition is to direct the respondents particularly 3rd respondent to release the registered sale deed vide: Vide P/Thenkanikottai/81/2024 (receipt No.17436/2024) registered on 11.12.2024 which was pending before the third respondent bearing old survey No.60 and new Survey No.60/1, measuring to an extent 3.00 acres situated at Nellamaru Agraharam Village, Denkanikottai Taluk, 2/6

2. Mr.Abishek Murthy, learned Government Advocate takes notice on behalf of the respondents. By consent of both the parties, this writ petition is taken up for final disposal at the stage of admission itself.

Learned counsel for the petitioner submitted that the petitioner purchased a property measuring an extent of 3.00 acres comprised in S.No.60, situated at Nellamaru Agraharam Village, Denkanikottai Taluk, Krishnagiri District - 635 107 from M/s.Efficient Agencies (P) Ltd., represented by its Director, Mrs.Shobha Sridharan. This being so, one MR.Rahamathullah Sheriff attempting to interfere with the above said property. Therefore, the petitioner herein filed O.S.No.141 of 2009, seeking declaration of ownership and a decree of permanent injunction, which was decreed in favour of the petitioner on 28.01.2013. Subsequently, the petitioner decided to sell the aforesaid property to one Mr.T.K.Sathisha and executed a sale deed. When the petitioner intended to register the sale deed, the third respondent registered the same on 11.12.2024 and kept the said document as pending, without releasing. Hence, the petitioner has come forward with the present writ petition. 3/6

4. Learned Government Advocate appearing for the respondents would submit that in the present case, there is an attachment in the subject property by the Official Liquidator. Therefore, the respondents are not in a position to release the document. He would further submit that, the respondents will pass the order of refusal check slip, within a period of one week.

5. Heard the learned counsel on either side and perused the materials available on record.

6. In view of the above, it is clear and evident that unless and otherwise the attachment order is lifted or NOC is obtained, the attachment order passed by the Official Liquidator continues. Certainly, no further document can be registered in the same survey number. Such being the case, the respondents are directed to take a decision with regard to release of the said document and assign the reason for their inability to release the same.

In view of the above, this writ petition stands disposed of. No costs.
