ORDER

When the matter was taken up for hearing today, the learned Additional Advocate General produced the copy of G.O.(D)No.216 Health and Family Welfare (A1) Department, dated 17.02.2026. The relevant portions in the G.O is extracted hereunder: "i. The name of Dr.J.A.Jayalal, Professor of General Surgery, Government Kanyakumari Medical College, Asaripallam, be included in the panel for the post of Dean in the appropriate palce in G.O.D.No.895, Health and Family Welfare Department, dated 04.08.2025 by relaxing the Special Rule for Tamil Nadu Medical Service in rule 8(c) of Category 13 in Annexure and para 11 under the heading "II.

Consideration of members for inclusion in the approved list" in Schedule - XI read with Section 7 of Tamil Nadu Government (CoS) Act, in his favour, since the punishment of Censure was in vogue during the panel period (i.e. from 11.09.2024 to 10.09.2025) and the disciplinary action initiated against him under rule 17(b) of the Tamil Nadu Civil Services (Discipline and Appeal Rules) as on date subject to the outcome of the Review Application pending before the Court, as follows: Sl.No. Name and Designation of the Medical Officer 2.

Dr.J.A.Jayalal, Professor of General Surgery, Government Kanyakumari Medical College, Asaripallam on his regular promotion is appointed and posted as Dean, Government Thiruvannamalai Medical College, Thiruvannamalai. iii. The service of Dr.J.A.Jayalal, Professor of General Surgery, Government Kanyakumari Medical College, Asaripallam, is regulated in the post of Dean from the date on which his immediate junior has taken charge in the post of Dean. iv. The pay of Dr.J.A.Jayalal, Professor of General Surgery, Government Kanyakumari Medical College, Asaripallam, is fixed in the promoted post of Dean on par with his junior in which date he has been promoted and joined duty in the post of Dean and to permit him to draw the monetary benefits from the date of taking charge of the said post as per Fundamental Rule 27(17).
