Respondent(s) PRAYER This petition is filed under Section 528 of BNSS, seeking to set aside the order passed by Principal District and Sessions Judge, Cuddalore in Crl.M.P.No.6254 of 2025 dated 24.09.2025 and pleased to relax the condition imposed upon the petitioner on the file of the Principal District and Sessions Judge, Cuddalore in Crl.M.P.no.4250 of 2025 on the file of Principal District and Sessions Judge, Cuddalore.

ORDER

The petitioner herein was granted bail by the learned Principal District and Sessions Court at Cuddalore District, Cuddalore, for the offences under Sections 296(b), 115(2) and 351(2) of BNS & Section 3 of PPD Act vide order dated 29.05.2025. Subsequently the petitioner has filed a relaxation petition in Crl.MP.No.4250 of 2025 before the learned Principal District and Sessions Court, Cuddalore District, Cuddalore and the condition was also modified by an order dated 18.06.2025 to the effect that he shall appear before the respondent police station on every 1st day of English calendar month till charge is sheet filed. Subsequently the petitioner has filed an another relaxation petition in Crl MP No.6254 of 2025 before the learned Principal District and Sessions Judge, Cuddalore District, Cuddalore and the same was dismissed by the Sessions Court vide an order dated 24.09.2025 on the ground that the investigation has not yet been completed and charge sheet has not yet been filed.

2. Now, the present petition has been filed seeking to set aside the order passed in Crl.MP.No.6254 of 2025 dated 24.09.2025 and also relaxation of the condition imposed upon the petitioner vide order dated 18.06.2025 in Crl.MP.No.4250 of 2025.

3.From a perusal of the materials available on record, it is seen that the

petitioner is regularly complying with the conditions before the respondent police. Hence, his further appearance is not necessary and accordingly, this Criminal Original Petition is allowed.
