The petitioners, who were arrested and remanded to judicial custody on 02.10.2025, for the alleged offence punishable under Sections 318(3) of BNS, 66D of IT Act, 2008 in Crime No.46 of 2025 on the file of the respondent police, seeks bail.

The case of the prosecution is that the defacto complainant, namely Karthikeyan, who is residing at No.306, Kanthampaa Colony, Annathanapatty, Salem had lodged a complaint before the respondent police station. In his complaint, the defacto complainant is working as Medical Representative in Mankind Pharma Limited. On 25.07.2025 at about 02.20 p.m., while the defacto complainant was seeing facebook, one person stating his name as Sanjay became friend to him. The said Sanjay informed the defacto complainant that an App is in the name of IDG - E Commerce Marketing App and if the defacto complainant is invested the money in the said App, he will get more profit and sent a link from his mobile No.8259015543 to the defacto complainant's mobile No.9787338334. Believing the words of Sanjay, the defacto complainant invested a sum of Rs.
2,35,000/- on 11.08.2025 and Rs.1,30,000/- on 18.08.2025. Then the said Sanjay informed that the defacto complainant had got more profit for the amount invested by him and when the defacto complainant demanded to give the profit amount to him, Sanjay instructed the defacto complainant to invest further sum of Rs.6,50,000/- and accordingly on 25.08.2025, the defacto complainant invested the said amount, then the said App disappeared. In order to rectify the same, Sanjay asked to give screen share and when the defacto complainant gave screen share, all the particulars in the mobile phone of the defacto complainant were deleted. Thereby, some Mysterious people cheated the defacto complainant to the tune of Rs.10,15,000/- by giving fake information. Hence the present complaint has been filed.

The learned counsel appearing for petitioners submitted that the petitioners have not committed any offence as alleged by the prosecution, and the petitioners were friends of A1 and on the basis of statement given by A1 these petitioners have been falsely implicated in this case and they have not any bad antecedents and they are in judicial custody from 02.10.2025. Hence, he prays for grant of bail.
4. The learned Government Advocate (Crl. Side) appearing for respondent would submit that though it is stated that the 1st petitioner have not any previous case, investigation is going on and the 2nd petitioner namely Ashiq Muhammed already detained under Act 14 of 1982 so far no amount is recovered, that these petitioners have also shared the amount collected from the defacto complainant. Hence, he opposed to grant bail to the petitioners.
5. Considering the fact that the 2nd petitioner Ashiq Muhammed detained under Act 14 of 1982, and so far no amount is recovered from any of the petitioners, investigation is not completed, and this Court is not inclined to grant bail to the petitioners.
