O R D E R

The petitioner, who was arrested and remanded to judicial custody on 27.09.2025 for the alleged offence under Sections 364, 302, 394 r/w 397, 1/6

302 r/w 201,120B, 34 of IPC, 1860 in Crime No.181 of 2010 on the file of the respondent police, seeks bail.

2. The allegation against the petitioner is that the petitioner earlier arrested and released on bail for abduction and murder for his personal gain. Since the petitioner was absent, non bailable warrant was issued on 14.08.2025 and the non bailable warrant was executed on 27.09.2025. Hence, this petition.

3. The learned counsel appearing for the petitioner submitted that only one hearing, the petitioner was absent, hence non bailable warrant was issued against him and he was immediately arrested. He further submitted that he will cooperate with the trial process. Further, the petitioner is in judicial custody from 27.09.2025 He further submitted that the petitioner is ready to abide by any conditions that may be imposed by the this Court. Hence, he prays to grant bail to the petitioner.

The learned Government Advocate (Criminal Side) appearing for the respondent police reiterated the prosecution case and submitted that there are totally six accused involved in this case and this petitioner is ranked as A3 and earlier he was regularly appeared before the Court. He was absent on only one hearing on 14.08.2025 hence non bailable warrant 2/6

was issued against him and subsequently he was arrested on 27.09.2025. Now the case is posted for examination of LW4 to LW6. Hence, he opposed to grant bail to the petitioner.

5. Heard both sides and perused the materials available on record.

6. Considering the fact that the petitioner was earlier regularly appeared and absent on 14.08.2025 and arrested on 27.09.2025 and the trial is in progress. Though, previous cases are cited, I am inclined to grant bail to the petitioner with certain conditions.

Accordingly, the petitioner is ordered to be released on bail on his executing a bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties, for a like sum to the satisfaction of the learned II Additional District and Sessions Judge, Arakkonam and on further conditions that:

[a] the sureties shall affix their photographs and Left Thumb Impression in the Application for Surety ship [Judicial Form No.46 annexed to 'The Criminal Rules of Practice, 2019']. The learned Magistrate shall obtain a copy of any one of the identity proofs to ensure their identity;

[b] the petitioner shall report before the learned II Additional District and Sessions Judge, Arakkonam at 10.30 a.m for a period of three weeks and thereafter as and when required for interrogation;

[c] On breach of any of the aforementioned conditions, the learned Magistrate/Trial Court is entitled to pass appropriate orders against the petitioner in accordance with law as if the aforementioned conditions have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)13 SCC 283];

[d] If the accused thereafter absconds, a fresh FIR can be registered under Section 269 of B.N.S. 25.10.2025 Vv 4/6
