Respondents PRAYER : Criminal Original Petition is filed under Section 528 of Bharatiya Nagarik Suraksha Sanhita, praying to direct the 1st respondent to transfer the case in Crime No.10 of 2025 from the 2nd respondent and the 1st respondent herein who in turn transfer the same to the Inspector of Police, CBCID, Coimbatore under him to investigate the case in accordance with law.

O R D E R

This Criminal Original Petition has been filed seeking a direction to the 1st respondent to transfer the case in Crime No.10 of 2025 from the 2nd 1/4

respondent and the 1st respondent herein who in turn transfer the same to the Inspector of Police, CBCID, Coimbatore under him to investigate the case in accordance with law.

2. The case of the petitioner/defacto complainant is that the accused have sold the property by fabrication of documents and based on a complaint by the de facto complainant, a case in Crime No.10 of 2025 has been registered by the second respondent for the offences punishable under Sections 120B, 420 of I.P.C., and 3(1) of Tamil Nadu Public Property (Prevention of Damage & Loss) Act, 1992. Since the second respondent is not conducting the investigation properly and charge sheet is not filed, the present application has been filed by the petitioner seeking to transfer of investigation from the file of the second respondent to any other agency.

3. Per contra, the learned Government Advocate (Crl. Side) appearing for the respondents would submit that based on the complaint given by the petitioner, a case has been registered and during the course of the investigation, it was found that A2 and A3 have purchased the property from A1 and thereafter A2 and A3 have sold the same to the petitioner and subsequently A1 has again sold the very same property to A4 and A5. would submit that the investigation is pending and the respondents are taking every steps to collect the required documents from the appropriate Sub Registrars Office and the investigation is going on in a proper manner. He would further submit that the respondents will be able to file final report within a period of three months from today.

4. Recording the same, this Court finds that there is no reason to transfer the investigation. However a direction is issued to the 2nd respondent to get along with the investigation and file final report as expeditiously as possible, preferably within a period of three months from today. The Deputy Superintendent of Police (District Crime Branch) Coimbatore shall monitor the case done by the second respondent.

5. With the above observation, this Criminal Original Petition stands disposed of.
