O R D E R

The petitioner, who was arrested and remanded to judicial custody on 03.09.2025 for the alleged offence under Sections 331(3), 331(4), 305(a), 62 r/w 111 of BNS, 2023 in Crime No.269 of 2025 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that the petitioner joining hands with other accused trespassed in to the house of the defacto complainant and broke open the door and taken away 53⁄4 of gold jewels and also cash of Rs.7,000/- . Hence, the case.

3. The learned counsel appearing for the petitioner submitted that the petitioner has been falsely implicated in this case and he is in judicial custody from 03.09.2025. He further submitted that property also recovered from the petitioner and he is ready to abide by any stringent conditions that may be imposed by this Court. Hence, he prayed for grant of bail to the petitioner.

4. The learned Government Advocate (Criminal Side) appearing for the respondent police reiterated the prosecution case and reported that only portion of the property was recovered. Though both the accused were arrested, the petitioner herein is having 27 previous cases. Hence, he opposed to grant bail to the petitioner.

5. Heard both sides and perused the materials available on record. 2/4

6. Considering the fact that the petitioner is a habitual offender and involved in 27 previous cases, I am not inclined to grant bail to this petitioner.

7. Accordingly, this Criminal Original Petition is dismissed. 25.10.2025 Vv To
