O R D E R

The petitioner, who was arrested and remanded to judicial custody on 29.08.2025, for the offence punishable under Sections 5(l), 5(j)(ii), 5(n) r/w Section 6 of Protection of Children from Sexual Offence Act, 2012, r/w 1/4

Section 351(2) of BNS, 2023, in Crime No.257 of 2025, registered on the file of the respondent, seeks bail.

2. The case of the prosecution is that the petitioner is the relative of the victim girl, aged about 13 years old, had committed a penetrative sexual assault and she became pregnant. Hence, the complaint.

3. The learned counsel appearing for the petitioner submitted that due to a money dispute, a false complaint has been lodged. He further submitted that the investigation has been completed and the petitioner has been in custody since 29.08.2025. Hence, he prayed for grant of bail to the petitioner.

4. The learned Government Advocate (Crl.Side) appearing for the respondent police submitted that the final report has not yet been taken on file. He further submitted that the petitioner, being a relative of the victim girl, if he released on bail, he may tamper with the witnesses. Hence, he opposed for grant of bail.

Considering the gravity of the offence alleged against the petitioner, who is a relative of the victim girl, and though it is stated that the investigation has been completed, the final report has not yet been filed before the competent Court. Hence, this Court is not inclined to grant bail to the petitioner at this stage. However, the petitioner is at liberty to file a fresh bail application after the case is taken on file by the Special Court.
