O R D E R

The petitioner herein apprehends arrest at the hands of the respondent police for the offences punishable under Sections 303(2) of BNS and Section 21(1) of Mines and Minerals (Development & Regulations) Act, 1957, in Crime No.238 of 2025, on the file of the respondent Police, seek anticipatory bail.

2. The allegation against the petitioner is that the petitioner along with other accused were standing near the grave yard of Kollar and collecting "Bar Sand". Hence, the complaint.

3. The learned counsel for the petitioner would submit that the petitioner is an innocent person and he has been falsely implicated in this case. Hence, he prayed for grant of anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and submitted that, petitioner has no previous cases.

5. Heard the learned counsels on either side and perused the materials available on record.

6. Considering the gravity of the offence committed by the petitioner and this petitioner involved in damaging ecology by illegal quarrying the sand from water body, this Court is not inclined to grant anticipatory bail to the petitioner.

7. Accordingly, this Criminal Original petition is dismissed. 27.10.2025 kmm 3/4
