ORDER

The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Section 303(2) of BNS Act, in Crime No. 447 of 2025, on the file of the respondent Police, seeks anticipatory bail.

2. The case of the prosecution is that the defacto complainant, who is an Assistant Director Department of Geology and Mining, Dharmapuri, lodged a complaint before the respondent police stating that, when they inspected the area near Maveripatti Karuppan Kovil, they found that the petitioner had illegally transported four units of normal stones in Ashok Leyland Tipper Lorry. Hence, the case.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. He further submitted that he is ready to abide by any conditions that may be imposed by this Court. Hence, he prayed to grant anticipatory bail to the petitioner.

4. The learned Government Advocate (Criminal side) for the respondent police, submitted that the petitioner had involved in illegal transportation of four units of river sand. He further submitted that the petitioner has one previous case, similar in nature, pending against him. Hence, he opposed to grant anticipatory bail to the petitioners. 2/4

Considering the facts and circumstances of the case, nature of allegations, and the submissions made by learned counsels on either side, considering the fact that the petitioner has one previous case pending against him and the fact that the petitioner had allegedly indulged in illegal quarrying activities causing damage to the Government land, this Court is not inclined to grant anticipatory bail to the petitioner.
