O R D E R

The Criminal Original Petition has been filed to call for the records relating to the impugned FIR in Crime No.658/2016 on the file of 1st respondent police and quash the same.

The learned counsel appearing for the petitioner would submit that the facts of the instant case are similar to the facts of the cases in Jeevanandham and others vs. The Inspector of Police, Velayuthampalayam Police Station, Karur District reported in (2018) 2 LW (Crl) 606 and Sri Raja vs Inspector of Police, Sivakasi Town Police Station Virudhunagar District and others (Crl.O.P(MD) No.7922 of 2019 dated 30.08.2019) and hence, the said two decisions would apply on all fours in the instant case.

3. The learned Additional Public Prosecutor appearing for the first respondent would endorse the aforesaid submission. 2/4

4. In view of the above submissions made on either side, this Court is of the opinion that no useful purpose will be served by keeping the proceedings pending.

5. Accordingly, the Criminal Original Petition stands allowed and the proceedings in Crime No.658 of 2016, pending on file of the 1st respondent, is hereby quashed. Consequently, the connected miscellaneous petition is closed. 13.11.2025 Index :Yes/No Internet:Yes/No vsi To
