Respondent(s) PRAYER; This writ petition is filed under Article 226 of Constitution of India, to issue a Writ of Mandamus, directing the 1st respondent to consider the petitioners application dated 17.03.2023 file No.MA0101008056513 and to issue the passport in favour of the petitioner within a time frame fixed by this Honourable Court.

ORDER

This petition has been filed seeking a direction to the 1st respondent to consider the petitioners application dated 17.03.2023 file No.MA0101008056513 and to issue the passport in favour of the petitioner.

2. It is the grievance of the petitioner that the petitioner applied for a passport renewal application on 17.03.2024. On 08.10.2024, notice issued by the first respondent to the petitioner stating that a criminal case was pending against him and called for enquiry. On 06.01.2025, the petitioner submitted a detailed representation to the first respondent providing a proper explanation in response to the allegation mentioned therein. However, till date, no action is taken and hence, the present writ petition has been filed.

3. The learned counsel for the petitioner submitted that this Court may issue a direction to the first respondent to consider the petitioner's application and pass appropriate orders within the stipulated time as fixed by this Court.

4. On the other hand, the learned Counsel for the first respondent submitted that the representation will be considered and appropriate orders will be passed on merits within the time frame to be fixed by this court.

5. Heard the learned counsel for the petitioner and the learned Government Counsel appearing on behalf of the respondents and perused the

materials available on record.

6.Considering the facts and circumstances of the case and having regard the submissions made by the learned counsel on either side, the first respondent is directed to consider the petitioner's application dated 17.01.2023 and pass orders on merits and in accordance with law, within a period of four weeks from the date of receipt of a copy of this order.

7.With the above direction, the writ petition stands disposed of.
