2. Heard the learned counsel for the petitioners.

3. Despite the receipt of notice, the first respondent neither appeared nor entered appearance through his counsel.

4. The learned counsel for the second respondent has got objections in allowing the application.

5. Accepting the averments made in the affidavit filed in support of this petition, this petition is allowed subject to the condition that the interest for the delay period of 241 days shall stand waived.
