Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the respondent to consider and dispose of the petitioner representation dated 12.06.2025 and thereby execute the lease deed in favour of the petitioner in accordance the Wakf Properties Lease Rules-2014 within the time frame as fixed by this Hon'ble Court.

ORDER

This writ petition has been filed seeking to direct the respondent to consider the petitioner's representation dated 12.06.2025 and to consequently, execute a lease deed in favour of the petitioner in accordance the Wakf Properties Lease Rules, 2014.

2. Mrs.N.Swathi Priya Raj, learned counsel takes notice on behalf of the respondent. In view of the consent expressed by the learned counsel on either side, this writ petition is taken up for final disposal at the admission stage itself.

Learned counsel for the petitioner would submit that the petitioner is the neighbouring property owner of the property belonging to Soorsha Makkan Wakf Estate which is situated at Saidapet, Chennai. Further, the Wakf has no Muthawalli and the respondent wakf board is having control of the said property belonging to the Soorsha Makkan Wakf Estate. While so, the petitioner, in order to take on lease the property which is adjoining his property, for the purposes of developing a commercial complex, made 2/5

representation before the respondent wakf on 12.06.2025. However, till date, the said application has not been acted upon. Hence, the petitioner is constrained to move this Court seeking issuance of a Writ of mandamus.

4. Learned counsel for the respondent would submit that the Wakf board is yet to be constituted and upon constitution, the petitioner's representation dated 12.06.2025 will be considered and appropriate orders will be passed on merits.

In view of the above submission made by the learned counsel appearing for the respondent, this Court, without going into the merits of the case, directs the respondent to consider the petitioner's representation dated 12.06.2025 and pass appropriate orders on merits and in accordance with law, within a period of twelve (12) weeks from the date of receipt of a copy of this order, after affording an opportunity to the petitioner by way of personal hearing to the petitioner.

6. With the above directions, this writ petition stands disposed of. No costs.
