The petitioners, who were arrested and remanded to judicial custody on 08.04.2025, for the offence punishable under Sections 120B, 147, 148, 450, 302 ( 3 Counts) read with Section 149 of IPC in Crime No.896 of 2023, registered on the file of the respondent, seeks bail. 1/4

2. It is seen that, this Court by an order dated 17.09.2025 in Crl.O.P.No.25466 of 2025 dismissed the petitioner's bail petition by stating the following reasons:

This Court has continuously dismissed the bail petitions filed by the petitioner considering the gravity of the offence committed by the petitioner and the stage in which the petitions are considered and noting that here is no change in circumstances of the case. Since the trial is in progress and it is pending for examination of further witnesses and the trial is likely to tamper the evidence and hamper the investigation. Hence, this Court is not inclined to grant bail to the petitioner.

Now, the learned counsel for the petitioner submitted that the petitioner is suffering form chicken pox and he is undergoing treatment and hence, he seeks bail on medical ground.

Considering the fact that the trial is pending in this case and the case is posted for examination and at this stage, if the petitioner is released on bail, there is a possibility that the petitioner would abscond and the trial will get stalled and hence, this Court is not inclined to grant bail to the petitioner at this stage.
