The petitioner herein apprehends arrest at the hands of the respondent police for the offence punishable under Sections 123 and 286 of the 1/4
Bharatiya Nyaya Sanhita 2023, read with Section 24(1) of the Cigarette and other Tobacco Products Act, 2003 (COTPA), in Crime No.352 of 2025, on the file of the respondent Police, seeks anticipatory bail.
2. The case of the prosecution is that the petitioner along with other accused were found to be in illegal possession of 250 kgs of prohibited tobacco products. Hence, the case.
3. The learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and has been falsely implicated in this case. Though previous cases have been cited against the petitioner, all those cases pertain to lottery offences. Hence, he prays to grant bail to the petitioner.
4. Learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and opposed the grant of bail to the petitioner on the ground that the petitioner is involved in 10 previous cases. He further submitted that the investigation in this case has not yet been completed.

5. Heard the learned counsels on either side and perused the materials available on record.
6. Considering the nature of the allegations and the fact that the petitioner was found in illegal possession of 250 kgs of prohibited tobacco products and has bad antecedents, this Court is not inclined to grant bail to the petitioner.
