O R D E R

This writ petition has been filed for the issue of a writ of mandamus directing the 3rd respondent to cancel the sub-division made in the subject property within the time frame fixed by this Court.

2. Heard both sides and perused the materials available on record.

3. The case of the petitioner is that the subject property was partitioned through a registered Partition Deed dated 25.04.1986 registered as document No.360/1986 and the petitioner's father was allotted C-schedule property. The petitioner's father died on 25.06.2024 leaving behind his wife and two sons. When the petitioner verified the revenue records, it came to the notice of the petitioner that a sub-division has been carried out, which was not in consonance with the boundaries mentioned in the Partition Deed dated 25.04.1986. In view of the same, the petitioner submitted a representation to the 1st respondent, which was forwarded to the 2nd respondent and the 2nd respondent, in turn, forwarded it to the 3rd respondent, for conducting an enquiry. The grievance of the petitioner is that thereafter, there was absolutely no progress. It is under these circumstances, the present writ petition has been filed before this Court. 2/4

Taking into consideration the facts and circumstances of the case and the materials placed before this Court, there shall be a direction to the 3rd respondent to act upon the representation made by the petitioner dated 20.03.2025 and take a decision on its own merits and in accordance with law, after affording opportunity to the interested parties concerned, within a period of eight weeks from the date of receipt of a copy of this order.
