O R D E R
This writ petition has been filed to direct the second respondent/The District Collector (Revenue) to consider the petitioner's representation dated 11.01.2019 and 12.06.2025 to re-determine the compensation awarded to the petitioner for his lands mentioned above in the tabular column measuring an extent of 0.81.45 Ares acquired at Karasur Revenue Village in Award No.2/2008 to a sum of Rs.21,261/- per Are, pursuant to the enhanced compensation award passed in LAOP No.110 of 2012 on the file of II Additional District Judge, Puducherry.
2. Mr.R.Sreedhar, learned Additional Government Pleader takes notice on behalf of the respondents. By consent of both the parties, this
writ petition is taken up for final disposal at the stage of admission itself.
3. The case of the petitioner is that the first respondent herein acquired the petitioner's land, measuring a total extent of 0.81.45 Ares, situated in Karasur Revenue Village of Villianur Taluk for the purpose of setting up of "Special Economic Zone" by invoking the urgency provision under Section 17(4) of the Land Acquisition Act. Since the final compensation determined by the third respondent was too low, many lands owners preferred an application, seeking enhancement of compensation. By which, one of the land owners preferred a reference application in LAOP No.110 of 2012, seeking enhancement of compensation and the same was allowed by enhancing the compensation from Rs.12,352/- per are to Rs.21,261/- per are, along with 30% solatium and 12% additional market value.
By virtue of the said order, petitioner herein made an application/representation dated 11.01.2019 & 12.06.2025, respectively, before the third respondent seeking to redetermine the compensation awarded to his land. However, till date, the same was not considered. Hence, the petitioner has come forward with the present writ petition.
4. Though many grounds have been raised in this writ petition, learned counsel for the petitioner submitted that, it would suffice, if this Court issues direction to the second respondent to consider the petitioner's application/representation dated 11.01.2019 & 12.06.2025.
5. Learned Additional Government Pleader appearing for the respondents submitted that the petitioner's application/representation dated 11.01.2019 & 12.06.2025 would be considered and appropriate orders passed, within a time frame that may be fixed by this Court.
6. Heard the learned counsel on either side and perused the materials available on record.
7. Considering the limited relief sought for by the learned counsel for the petitioners, this Court without going into the merits of the case, directs the second respondent to consider the petitioner's application/representation dated 11.01.2019 & 12.06.2025, after conducting enquiry, within a period of four weeks from the date of receipt of a copy of this order.
With the aforesaid direction, this writ petition is disposed of. No costs.
