O R D E R

The petitioner herein apprehends arrest at the hands of the respondent police for the offences punishable under Section 8(c) r/w 20(b)(ii)(B) of NDPS Act in Crime No.433 of 2024 on the file of the respondent Police, seeks anticipatory bail.

2. The case of the prosecution is that on 07.07.2024, based on the secret information, the respondent police came to know about selling of drug substance in the place of occurrence and they found that the accused Nos.1 to 4 were found in possession of 2 kgs of ganja and on confession of 1st accused they came to know about the involvement of this petitioner and the fifth accused in the above said offence, thereby this petitioner has been arrayed as 6th accused in this case.

3. The learned counsel appearing for the petitioner submitted that, petitioner is an innocent person and he has been falsely implicated in this case. Hence, he prayed for grant of anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and submitted that, apart from this case, petitioner has twenty previous cases.

5. Heard the learned counsels on either side and perused the materials available on record.

6. Considering the gravity of the offence committed by the petitioner, and also the bad antecedents against the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner.

7. Accordingly, this Criminal Original petition is dismissed. 27.10.2025 kmm 3/4
