ORDER

In a suit for remedies in respect of alleged trade mark infringement and passing off relating to the use of the impugned mark MAAs, the plaintiff has applied to combine the causes of action relating to infringement and passing off.

2. The plaintiff is the registered proprietor of the trade mark MAA in relation to beverages. The basis of the action for infringement and passing off is the use of the impugned mark MAAs. Given the common basis of these actions, it is just and appropriate that the causes of action be combined so as to avoid multiplicity of proceedings. The defendant also has no objection to this application being allowed.

3. For reasons set out above, this application is allowed as prayed for.
