Writ Petition filed under Article 226 of the Constitution of India seeking issuance of a Writ of Mandamus directing the respondents 1 to 4, herein to desist from causing hindrance on the basis of reduced extent of patta / FMB in Patta No 2309 dated 29.06.2023 in respect of the sub division S.No.237/2B1A1A to the existing building standing from the year 1997 contravening earlier extent of patta / FMB in Patta No 2309, dated 09.01.2018 in Sub Division S.No.237/2B1A Molasur village, Kancheepuram District without considering the civil court case and the Revenue Appeal before the Revenue Divisional Officer. ORDER

This writ petition has been filed seeking issuance of a writ of mandamus directing the first respondent to dispose of the appeal dated 17.09.2025 within the time frame fixed by this Court.

2. Heard Ms.N.S.Rachel Catherine, learned counsel for petitioner, Mr.D.Ravichander, learned Special Government Pleader appearing for respondents 1 and 2 and Mr.M.S.Arasakumar, learned Government Advocate appearing for respondents 3 and 4.

3. The case of the petitioner is that there is a civil suit filed by the petitioner against the panchayat and respondents 5 to 6 in O.S.No.286 of 2015 regarding the pathway dispute and for a consequential injunction 2/4

not to disturb the petitioner's possession and enjoyment of the same.

4. The grievance of the petitioner is that on 17.09.2025, a patta was produced which is alleged to have been issued in the name of the petitioner on 10.06.2023 along with the FMB sketch showing the extent as 8.26 Ares and the eastern boundary is shown as 9.9 mts. instead of 16 mts.. This had taken place even without the petitioner seeking for any correction of patta. Under these circumstances, the petitioner submitted an appeal before the first respondent on 17.09.2025. Since the same was not considered, the present writ petition has been filed.

5. Taking into consideration the facts and circumstances of the case and the materials placed before this Court, there shall be a direction to the first respondent to deal with the appeal dated 17.09.2025 on its own merits and in accordance with law after affording opportunity to all the interested parties and final orders shall be passed within a period of eight (8) weeks from the date of receipt of a copy of this order.
