O RDER This Writ Petition has been filed for direction directing the respondents to disburse the differential sum of Gratuity and Leave encashment benefits to the petitioner based on Dearness Allowance revision with effect from 01.07.2023 with interest at the rate of 8 percent per annum from the said date of entitlement to till the date of actual disbursement.
2. Heard the learned counsel on either side and perused the materials available on record.
3. The petitioner had joined in the first respondent Corporation as Driver and retired from service on 31.07.2023. The petitioner was granted Dearness Allowance with 42% of basic pay as on 01.04.2023. However, with effect from 01.07.2023, it was revised to 46% of basic pay. Therefore, the difference in Dearness Allowance is entitled by the petitioner, since the petitioner had retired from service on 31.07.2023.
4. In view of the above, the respondents are directed to disburse the applicable differential sum of gratuity and leave encashment benefits with
interest at the rate of 6% per annum to the petitioner, within a period of twelve weeks from the date of receipt of a copy of this order.
5. With the above directions, this writ petition stands disposed of. No costs.
