The petitioner, who was arrested and remanded to judicial custody on 20.09.2025, for the offence punishable under Sections 138, 140(4), 308(4) of of BNS, in Crime No.616 of 2025, registered on the file of the respondent, seeks bail.

2. The case of the prosecution is that the de facto complainant, a college student from Kerala, was allegedly abducted at night by the petitioner and other accused, taken to a scheduled place, assaulted, and demanded money. Later, the accused dropped the victim near a tea stall and fled. Hence, the complaint.

3. The learned counsel appearing for the petitioner submitted that due to a money dispute, a false complaint has been lodged. He further submitted that the petitioner has been in custody since 20.09.2025. Hence, he prayed for grant of bail to the petitioner.

4. The learned Government Advocate (Crl.Side) appearing for the respondent police submitted that the petitioner is a habitual offender. The petitioner had demanded money from the de facto complainant, and since he did not have any money, the petitioner along with other accused persons assaulted him. He further submitted that the investigation is still pending and petitioner has 23 previous cases. Hence, he opposed for grant of bail. 2/4

5. Considering the gravity of the offences, the fact that the petitioner has previous criminal antecedents and the investigation has not yet been completed, this Court is not inclined to grant bail to the petitioner.
