ORDER

The petitioners, who were arrested and remanded to judicial custody on 26.09.2025, for the offences punishable under Sections 303(2) R/w 106 of BNS in Crime Nos.318, 319, 322 and 323 of 2025, registered on the file of the respondent police, seek bail.

The allegation against these petitioners is that they were all involved in theft of cell phones from various persons, who were travelling in train. Hence, this case 3.

The learned counsel appearing for the petitioners submitted that the petitioners have been falsely implicated in this case and they are in judicial custody since 26.09.2025. He further submitted that the petitioners are ready to abide by any conditions that may be imposed by this Court and sought for bail to the petitioners.

The learned Government Advocate (Criminal Side) appearing for the respondent while opposing the bail to the petitioners, reiterated the prosecution case and submitted that the petitioners are hailing from 2/4

Jharkhand; that the petitioners were possessed with 60 mobile phones and they have involved in various cases registered for the similar offences; and that the investigation of these cases are still pending. 5.

Considering the submissions made on both sides, gravity of offence, the petitioners have previous cases of similar offence and taking note of the fact that the investigation of the cases are pending, this Court is not inclined to grant bail to the petitioners. 6.
