ORDER
The Civil Revision Petition is filed challenging the order passed by the learned Metropolitan Magistrate, Additional Mahila Court, Egmore, Chennai, dated 15.10.2025.
By the impugned order, the Court below partly allowed the petition filed by the respondent/wife in M.P.No.384 of 2025 directing the petitioner to pay a sum of Rs.45,400/- towards the second term fee and transfer fees directly to the School.
If the petitioner is aggrieved by the said order passed by the Metropolitan Magistrate, he has got remedy of filing an appeal under Section 29 of the Domestic Violence Act as per law laid down by the Full 3/7
Bench of this Court in Arul Daniel and Others Versus Suganya, reported in (2022) SCC Online Mad 5435. Since the effective statutory remedy is available to the petitioner before the regular Court, this Court is not inclined to exercise its supervisory power under Article 227 of the Constitution of India, in view of the law laid down by the Hon'ble Supreme Court in the case of Virudhunagar Nadargal Dharma Paripalana Shabha Vs Tuticorin Educational Society reported in MANU/SC/1365/2019. Accordingly, this Civil Revision Petition stands dismissed with liberty to the petitioner to file an appeal before the appropriate forum. No costs.
