Mr.N.Subramaniyan for Mr.L.Sathyaraj - for R1 Mr.V.Vijayashankar - for R2 Judgment (Judgment of the Court was delivered by R.Suresh Kumar J.) This intra Court appeal has been filed against the order dated 01.08.2024 passed by the Writ Court made in W.P.No.28871 of 2023.
2. The question raised for consideration before the Writ Court was that the revised pay scale following the VI Pay Commission recommendation would apply only to the ordinary scale of pay or even to selection scale of pay, which has already been achieved by the employees prior to 01.01.2006.
3. The issue was already decided by this Court in W.P.Nos.15570 of 2021 etc., batch of cases by an order dated 29.02.2024, where, the issue has been extensively discussed and decided in favour of the employees. The said order has been followed in the present writ petition through the impugned order by the learned Writ Court and thereby allowed the said writ petition. As against the said order dated 29.02.2024 in W.P.No.15570 of 2021 etc., batch, admittedly no intra Court appeal has so far been moved. Therefore, there has been no contra facts come up from the Government side.
4. When that being so, the order passed by the Writ Court in W.P.No.15570 of 2021 etc., batch has become final and if that order is followed in extenso in the present writ petition by the learned Writ Court, thereby allowing the writ petition through the impugned order, we do not find any reason to interfere with the same. Hence, the present writ appeal is liable to be dismissed and accordingly it is dismissed. No costs. Consequently, connected miscellaneous petition is closed. (R.S.K.,J.)
