ORDER
The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Section 399 of IPC in S.C.No. 124 of 2018 on the file of X Additional Sessions Judge at Chennai, in Crime No. 244 of 2009 on the file of the respondent Police, seeks anticipatory bail.
2.Today, when the matter came up for hearing, Mr.S.Udayakumar, learned Government Advocate, [Criminal Side] appearing for the respondent/State submitted that the petitioner was absent on 01.09.2025, and therefore, an NBW was issued by the learned X Additional Sessions Judge, Chennai, against the petitioner in S.C.No.124 of 2018 in connection with Crime No. 244 of 2009 and he has filed an anticipatory bail application before the trial Court for the alleged offence under Section 399 of IPC and the matter was posted on 16.09.2025 for further hearings. He further submitted that 18 previous cases are pending against him.
3.After hearing the submissions made by the learned Counsel on either side, this Court directs the petitioner shall surrender before the Trial Court concerned and recall the Non Bailable Warrant (NBW) Further, the Trial Court is directed to consider the recall petition which had already filed by the petitioner and pass appropriate orders, on merits on the same day and in accordance with law.
4. Accordingly, this Criminal Original Petition is disposed of. 30-10-2025 MSM
