ORDER

The petitioner, who apprehend arrest at the hands of the respondent police for the alleged offences punishable under Sections 6(4) TN of Scheduled commodities Act (RDCS) order 1982 & 7(1)(a)(ii) Essential Commodities Act, 1955 in Crime No.335 of 2024, seeks anticipatory bail.

2. The case of the prosecution is that petitioner was in illegal possession and transportation of 25,000 kgs of PDS Rice without any valid permission or license. Hence, the case.

3. The learned counsel for the petitioner would submit that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution and he is ready to abide by any stringent condition that may be imposed on him. Hence, he prays for anticipatory bail to the petitioner.

3. The learned Government Advocate (Crl.Side) would submit that this is a case involving 25,000 kgs of rice intended for the public distribution system. He further submitted that there is no previous case pending against the petitioner. Hence, he opposed for grant of anticipatory bail to the petitioner.

4. Considering the nature of offence committed by the petitioner and also

taking note of the fact the huge quantity of essential commodities seized, as custodial interrogation of the petitioner is very much required. Therefore, this Court is not inclined to grant anticipatory bail to the petitioner.
