The petitioner, who apprehends arrest by the respondent police for the offences punishable under Sections 303(2) and 326(a) of BNS 2023 r/w 21(1) of Mines and Minerals (Development and Regulation) Act, 1957 in Crime No.173 of 2025 seeks anticipatory bail. 2.The allegation against the petitioner is that he joined with other 1/4

accused had illegally quarried sand by using a lorry and a JCB earthmover, thereby causing damage to the land and the water body. Hence, the complaint.

3.The learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and has been falsely implicated in this case. He further submitted that the petitioner has no previous case and that the petitioners had only levelled the sand and had not engaged in illegal sand quarrying. Hence, he prayed for grant of anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and submitted that the petitioner was found in possession of two units of red sand transported in a lorry by using an earthmover. Hence, he opposed for grant of anticipatory bail to the petitioner.

5. Heard the learned counsel for the petitioner as well as the learned Government Advocate (Crl.side) and perused the materials available on record.

6. Considering the submissions made by the learned counsel on either side, the fact that though the petitioner has no previous case against him and that the petitioner had allegedly indulged in illegal quarrying activities causing damage to the ecology and river bed. At this stage, if the petitioner 2/4

is released on anticipatory bail, there is every likelihood of his indulge in similar activities. Hence, this Court is not inclined to grant anticipatory bail to the petitioner.
