] The learned Senior Counsel appearing on behalf of the petitioner/appellant would submit that they are members of the Electoral Body for election to be conducted for Indian National Trade Union Congress, Tamil Nadu Branch. However, they have not been impleaded as party-defendant in the suit, and a final order passed to conduct the election by appointing an Election Commissioner. This has infringed the rights and denied them opportunity to participate in the process of election in the civil suit.

2. Thus, Leave granted.
