ORDER

This application has been filed by the applicant to receive the documents.

2. According to the applicant, he is the defendant in the main suit. At the time of filing written statement, the petition mentioned documents are not available with him. Therefore, unable to file those documents. Hence, filed this application.

3. The learned counsel for the respondent strongly opposed to allow this application that those documents have not been filed along with the written statement. Moreover, all the documents are not relevant to this case and therefore, strongly objected.

4. Considering the reasons stated in the affidavit and the nature of application, it is appropriate to allow this application. Therefore, this application is allowed and the documents can be received subject to proof, relevancy and 2/4

admissibility. The respondent is at liberty to raise any objections at the time of marking the documents in all aspects.

5. Post the matter before the learned Master for recording evidence on 24.02.2026.
