This Civil Miscellaneous Petition has been filed to condone the delay of 1603 days in filing the above appeal.

2. Heard the learned counsel for the petitioner and the learned counsel for the second respondent.

3. The petitioner, who is the father of the injured minor, would aver that the Award was passed by the Tribunal on 01.02.2021. Even thereafter, from the year 2021 till date, the minor is under continuous treatment and lastly on 22.09.2025, she was given treatment and there occurred a delay of 1603 days in preferring this Civil Miscellaneous Appeal

4. The learned counsel for the 2nd respondent has got serious objections in allowing the petition, since after a long period from the date of the order, this petition is taken out to condone the delay in preferring the Civil Miscellaneous Appeal.

Accepting the averments made by the petitioner in the affidavit enclosed with the petition, this Court is inclined to allow this Civil Miscellaneous Petition subject to the condition that the interest for the delay period of 1603 days shall stand waived. Accordingly, this Civil Miscellaneous Petition is ordered.
