PRAYER:- Writ Petition filed under Article 226 of the Constitution of India, praying for an issuance of Writ of Certiorarified Mandamus, to call for the records relating to the "Refusal Check Slip" dated 16.10.2025 bearing Refusal number RFL / Ambattur / 35/ 2025 issued by the 3 rd respondent in refusing the sale deed presented on 16.10.2025 bearing a temporary No:TP / 236394398 / 2025 executed by the petitioner in favour of Mrs.S.Latha and quash the same and consequently direct the 3 rd respondent to register the documents on presentation bearing a temporary No: TP / 236394398 / 2025. ORDER

This writ petition has been filed by the petitioner challenging the Refusal Check Slip dated 16.10.2025 bearing Refusal number RFL / Ambattur / 35/ 2025 issued by the 3 rd respondent in refusing the sale deed presented on 16.10.2025 bearing a temporary No:TP / 236394398 / 2025 executed by the petitioner in favour of Mrs.S.Latha.

2.Mr.L.Baskaran, learned Government Advocate takes notice on behalf of the 1 st respondent and Mr.Arasa Kumar, learned Government Advocate, takes notice on behalf of the respondents 2 & 3. By consent of the parties, the main writ petition is taken up for disposal at the admission stage itself. 3.Learned counsel for the petitioner would submit that the petitioner executed a sale deed in respect of the subject property bearing S.No.101/1B to an extent of 2865 sq.ft, which is comprised in Plot No.33, No.51, Subramania Nagar, Thirumulaivoyal Village, Ambatur Taluk, Thiruvallur District in favour of one Latha and presented the same before the 3 rd respondent for registration on 16.10.2025, along with all the necessary documents. However, the 3 rd respondent issued a impugned refusal note stating that his office has received a letter dated 25.

11.2024, bearing Ref No.CNO.1185/DC CCB/AVD/COPGRI/2024, whereby the 1 st respondent has directed the 3 rd respondent to stop the registration of the subject property since an investigation was pending based on the complaint given by one P.Sathyamoorthy.

4.He would further submit that since some third party had lodged a complaint, the 1 st respondent cannot issue such communication stating not to register the subject property. Hence, he prayed for a direction to the 3 rd respondent to register the sale deed presented by the petitioner. 5.Learned Government Advocate (Crl. Side) appearing for the 1 st respondent after getting instruction would submit that, initially, the 1 st respondent sent a communication dated 25.11.2024, directing the 3 rd respondent not to register any of the document regarding the subject property. Thereafter, the 1 st respondent recalled the said communication dated 25.11.2024, by virtue of the letter dated 29.10.2025. Therefore, appropriate orders may be passed. 6.Learned Government Advocate appearing for the 3 rd respondent would submit that since there was a direction from the 1 st respondent not to register any document pertaining to the subject property, the impugned refusal check slip dated 16.10.2025 was issued and now the 1 st respondent had recalled the

said direction by virtue of letter dated 29.10.2025. Therefore, appropriate orders may be passed and the same will be complied by the 3 rd respondent.

7.Heard the learned counsel for the petitioner; learned Government Advocate (Crl.Side) appearing for the 1 st respondent and the learned Government Advocate appearing for the respondents 2 and 3 and perused the materials available on record.

8.Considering the submissions made by either parties, it is evident that the 3 rd respondent had issued the refusal check slip dated 16.10.2025, refusing to register the sale deed presented by the petitioner and his purchaser on 16.10.2025, on the ground that there was a direction from the 1 st respondent not to register the documents in respect of the subject property. However, since the said direction was recalled by the 1 st respondent vide letter dated 29.10.2025, the 3 rd respondent has no impediment to register the sale deed dated 16.10.2025. In such view of the matter, the impugned refusal check slip dated 16.10.2025 is hereby set aside and this Court directs the 3 rd respondent to register the sale

deed dated 16.10.2025 executed by the petitioner in favour one Latha, forthwith, after the re-presentation of the same. 9.With the above direction, this writ petition is disposed of. No costs.
