ORDER

The petitioners, who apprehends arrest for the alleged offence punishable under Sections 303(2), 326(a) of BNS Act, 2023 r/w 21 of MM Act in Crime No.50 of 2025 on the file of the respondent police, seeks anticipatory bail.

2. The allegation against these petitioners is that the petitioners were transporting 2 units of stolen sand by using Mini Tipper Lorry without valid permission. Hence, the case.

3. The learned counsel appearing for the petitioners submitted that the petitioners have not committed any offence as alleged by the prosecution and they have been falsely implicated in this case. Hence, he prays for grant of anticipatory bail.

4. The learned Government Advocate (Crl. Side) appearing for the respondent submitted that the petitioners, arrayed as A1, A2, have no previous cases pending against them, they are accused of transporting two units of sand without permission. Hence, he vehemently opposed to grant anticipatory bail to the petitioners.

5. Heard both sides and perused the materials available on record including the First Information Report.

6. Considering the submissions of the learned counsel on either side, the petitioners involved illegally transporting the sand, though no previous case is pending against the petitioners, and this Court is not inclined to grant anticipatory bail to the petitioners.
