O R D E R

The petitioner, who was arrested and remanded to judicial custody on 02.08.2025 for the alleged offence under Section 406 and 420 of IPC in Crime No.165 of 2025 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that the petitioner under the pretext of engaging the defacto complainant in a T.V programme and collected a sum of Rs.23,00,000/-. Subsequently, when the defacto complainant demanded the money back, the petitioner has issued a cheque for a sum of Rs.50,00,000/- and the same was also dishonoured. Hence, the present case.

3. The learned counsel appearing for the petitioner submitted that the petitioner was arrested on 02.08.2025, the petitioner is not having any previous case. He further submitted that already investigation completed and final report also filed. Hence, he prays to grant bail to the petitioner. 4.The learned counsel appearing for the Intervenor submitted that this petitioner has collected huge amount under the pretext of getting a carrier 2/6

opportunity in the Satellite Channels and subsequently issued a cheque for the repayment of money collected and same was dishonoured. He further submitted that it is a clear case of cheating and opposed to grant bail to the petitioner.

5. The learned Government Advocate (Criminal Side) appearing for the respondent police reiterated the prosecution case and reported that investigation completed and final report also filed and yet to taken on file by the concerned Magistrate. Hence, he opposed to grant bail to the petitioner.

6. Heard both sides and perused the materials available on record.

7. Considering the facts and circumstances of the case, the period of incarceration, investigation is also concluded and petitioner is not having bad antecendents, I am inclined to grant bail to the petitioner with certain conditions.

8. Accordingly, the petitioner is ordered to be released on bail on his executing a bond for a sum of Rs.25,000/- (Rupees Twenty Five 3/6

Thousand only) with two sureties, for a like sum to the satisfaction of the learned XXIII Metropolitan Magistrate, Saidapet, Chennai and on further conditions that:

[a] the sureties shall affix their photographs and Left Thumb Impression in the Application for Surety ship [Judicial Form No.46 annexed to 'The Criminal Rules of Practice, 2019']. The learned Magistrate shall obtain a copy of any one of the identity proofs to ensure their identity;

[b] the petitioner shall report before the respondent police at 10.30 a.m for a period of three weeks and thereafter as and when required for interrogation;

[c] On breach of any of the aforementioned conditions, the learned Magistrate/Trial Court is entitled to pass appropriate orders against the petitioner in accordance with law as if the aforementioned conditions have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)13 SCC 283];

[d] If the accused thereafter absconds, a fresh FIR can be registered under Section 269 of B.N.S. 4/6
