ORDER

The petitioner, who apprehend arrest at the hands of the respondent police for the alleged offences punishable under Section 123 of BNS r/w. Section 24(1) of COTPA Act in Crime No. 272 of 2025, seeks anticipatory bail. 2.The case of the prosecution is that petitioner was found in possession of 42 kgs of tobacco products without valid permission. Hence this case. 3.The learned counsel appearing for the petitioner submitted that this is second anticipatory bail application and the earlier application was dismissed by this Court in Crl.O.P.No.28537 of 2025 dated 17.10.2025. He further submitted that the petitioner has not committed any offence as alleged by the prosecution and he has been falsely implicated in this case. Hence, he prays for grant of anticipatory bail.

The learned Government Advocate (Crl.Side) appearing for the respondent submitted that the petitioner seized 42 kgs of tobacco products without valid permission and one previous case is pending against the petitioner. Hence, he opposed to grant anticipatory bail to the petitioner. 5.This Court earlier dismissed the anticipatory bail application filed by the petitioner in Crl.O.P.No.28537 of 2025 dated 17.10.2025 on the following reasons;

"5.Considering the submissions of the learned counsel on either side, that one previous case is pending against the petitioner and it is similar in nature, and this Court is not inclined to grant anticipatory bail to the petitioner."

6.In view of the above, this petition has been filed within one week, without any change in circumstances. Hence I am not inclined to revisit the earlier order passed by this Court. According, this Criminal Original Petition is dismissed.
