O R D E R

The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 305(c), and 326(a) of the BNS, 2023 in Crime No. 257 of 2025, on the file of the respondent Police, 1/6

seeks anticipatory bail.

2. The allegation against the petitioner is that on 28.09.2025 at about 3.00 pm, the petitioner joining with other accused had quarried one unit sand from Puthagaram Lake and had transported by using bearing Registration No. TN-86-R-4615 without any valid licence from the Government of Tamil Nadu. The respondent police seized the vehicle. Hence the case.

3. The learned counsel for the petitioner submits that the petitioner is an innocent person and he has been falsely implicated in this case. He submits that he has not committed any offence as alleged by the prosecution. He also submits that the petitioner is ready to abide by any conditions that may be imposed by this Court and ready to furnish sufficient solvent sureties for his release. Hence, he prays for grant of anticipatory bail to the petitioner.

4. The learned Government Advocate (Criminal side) for the respondent police, reiterated the prosecution case and submits that the 2/6

petitioner along with other accused had quarried one unit sand from Puthagara Lake and illegally transported the sand by using goods vehicle bearing Registration No.TN-86-R-4615 without any valid licence from the Government of Tamil Nadu. He further submits that the petitioner is arrayed as A2. He further submits that investigation is pending and he has one previous case. However, he opposed to grant anticipatory bail to the petitioner.

5. Heard the learned counsels and perused the materials available on record.

Considering the fact that the petitioner had quarried the sand from lake and the same was transported illegally; that the petitioner has one previous case similar in nature; if the anticipatory bail grants to the petitioner he would indulge in similar type of activities and he damaged the ecology and water body, this Court is not inclined to grant anticipatory bail to the petitioner.
