ORDER

The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 21(1), 4(1) (1A), 21(4) of Mines and Minerals (Development and Regulation) Act, 1957 read with Sections 303 and 326(a) of the Bharatiya Nyaya Sanhita, 2023, in Crime No. 330 of 2025, on the file of the respondent Police, seeks anticipatory bail. 1/6

The allegation against the petitioner is that on 16.10.2025 at 8.00 am., the petitioner joined hands with other accused had illegally quarried one unit river sand near Usinattan Vattam Lake by using Mahindra Tractor bearing Registration No. TN-24-B-4565 without any valid license from the Government of Tamil Nadu. Hence the complaint.

3. The learned counsel for the petitioner submits that the petitioner has not committed any offence as alleged by the prosecution and he has been falsely implicated in this case. He also submits that the petitioner is ready to abide by any conditions that may be imposed by this Court and ready to furnish sufficient solvent sureties for his release. Hence, he prays for grant of bail to the petitioner.

The learned Government Advocate (Criminal side) for the respondent police, reiterated the prosecution case and submits that the petitioner is having one previous case; though it is not similar in nature, investigation is pending. However, he vehemently opposed for grant of bail to the petitioner.

Considering the fact that the petitioner is not only involved in illegal quarrying but also damaged the ecology and water bodies, and if the anticipatory bail is granted to the petitioner, he would likely indulge in similar offences in the future, hence, this Court is not inclined to grant bail to the petitioner.

6.Accordingly, this Criminal Original Petition is dismissed. 30.10.2025 MSM To 1.The Inspector of Police Jolarpet Police Station Thirupathur District Crime No. 330 of 2025.
