Prayer : This writ petition has been filed under Article 226 of the Constitution of India, praying to issue a writ of mandamus, directing the 1st respondent to allow these petitioners to participate the enquiry proceedings based on the order passed by the Court made in W.P. O R D E R
The petitioner claims that he is the owner of the property situated at Veppanthattai Taluk. He claims to have purchased the property from two gentlemen viz., Saravanan and Manikandan. The sale-deeds have been executed by their power agent in favour of the petitioners.
2. The respondents 2 and 3 herein have alleged that it is a private road and that it was used as a public road earlier. Hence, they filed a writ petition in W.P. No. 16855 of 2025. The said writ petition was disposed of in the following terms:- "7. In view of the above facts and considering the limited relief sought for by the learned counsel for the petitioners, without going into the merits of the case, I am inclined to direct the first respondent, to consider the petitioners' representation dated 18.12.2023, for cancellation of the DTCP approval (No.55/2018) granted to the 2nd respondent, by affording reasonable opportunity to the petitioners as well as the 2nd respondent and pass appropriate orders on merits and in accordance with law, within a period of eight(8) weeks from the 2/5
date of receipt of a copy of this order."

The petitioner claims that the approval for his land was given as early as 2018 and therefore, any enquiry conducted with respect to the cancellation proceedings of the said approval would affect his rights. Hence, he is before this Court with a plea that he should also be permitted to be heard before orders are passed by the 1st respondent.
4. Mrs.C.Meera Arumugham, learned Additional Government Pleader, who takes notice for the 1st respondent, states that the 1st respondent, as directed by this Court will hear the petitioner, the complainants, and the 2nd respondent in W.P. No. 16855 of 2025, as well as any other person, who would be interested in sustaining the layout. The said statement is recorded. 5.The writ petition is disposed directing the 1st respondent to strictly comply with the orders of this Court in W.P. No. 16855 of 2025 by affording opportunity to all concerned. No costs.
