ORDER

This writ petition has been filed for a mandamus seeking for a direction to the respondents to remove the remarks made as "Zero valuation" for the property morefully described in the prayer to this writ petition. The petitioner also seeks for issuance of patta in his favour for said property.

2. The petitioner claims that earlier the property morefully described in the prayer to this writ petition was the subject matter of land acquisition. But, the said land acquisition proceedings was subsequently quashed by this Court in W.P.No.230 of 1998, dated 13.02.2002. Hence, the remarks made as "zero valuation" for the subject property has to be removed and patta has to be issued for the said property in favour of the petitioner. The petitioner had earlier given representations to the respondents and since those representations were not considered, the petitioner has filed this writ petition.

3. Till date, the respondents have not filed their counter affidavit.

4. No prejudice will be caused to the respondents if they are directed to pass final orders on merits and in accordance with law on the fresh representation to be submitted by the petition, within a time frame to be fixed by this Court. Accordingly, this writ petition is disposed of in the following manner:- __________Page 2 of 4

(a) The petitioner is directed to submit a fresh representation to the respondents 3 and 4 seeking for removal of remarks made in their records as "zero valuation" for the property, morefully described in the prayer to this writ petition, and also for issuance of patta, within a period of one week from the date of receipt of a copy of this order.

(b) On receipt of such representation, the respondents 3 and 4 shall pass final orders on the same, on merits and in accordance with law, and also by taking note of the order passed by this Court in W.P.No.230 of 1998, dated 13.02.2002, quashing the land acquisition proceedings, within a period of 12 weeks thereafter.
