PRAYER : Transfer Civil Miscellaneous Petition is filed under Section 24 of the CPC, to withdraw the case in MC.No.02 of 2025 pending on the file of the learned Judicial Magistrate II at Hosur, and transfer the same to the learned District Munsif Court at Hosur to be tried along with OS.No.88 of 202 filed by the petitioner.

ORDER

This Transfer Civil Miscellaneous Petition is filed seeking transfer of maintenance case in MC.No.02 of 2025 pending on the file of learned Judicial Magistrate-II, Hosur to the file of District Munsif Court, Hosur.

2. Since the petitioner seeks intra-district transfer, he has remedy to approach the concerned Principal Court. Hence, this Court is not inclined to exercise power under Section 24 of CPC and the Transfer Civil Miscellaneous Petition stands dismissed with liberty to the petitioner to approach the concerned Principal District Judge. No costs. Consequently, the connected miscellaneous petition is closed.
