ORDER

The petitioner who is represented by Mr.Gopalakrishnan, states that he is appearing on behalf of Mr.Sivakumar. Mr.L.S.M.Hasan Fizal, the learned Additional Government Pleader, appears for the first respondent and Mr.C.Sathish, learned Government Advocate, appears for R2 and R3.

2. The petitioner has come forward with a prayer to permit him to rejoin as a Panchayat Secretary. He claims that he was working at the Thenpathi Panchayat, Mannargudi Taluk, Thiruvarur District. He had been appointed on 03.04.2006. He pleads that, as the then Panchayat President and the Vice President had abused their powers, he had lodged a complaint with the Special Cell of the Chief Minister alleging illegalities, on 03.04.2013. According to the petitioner, without issuing a charge memo or following the principles of service law, the President of the Panchayat had instructed him not to come to Panchayat anymore. He lodged a detailed complaint before the State Authorities. Pursuant thereto, the Tahsildar had also issued show cause notices on 26.10.2017 and 30.01.2019. The petitioner states that as no response was given, he is before this

Court by way of mandamus.

3. Taking note of the allegation, I called upon Mr.C.Sathish, to verify whether the petitioner has been terminated from service by means of any proceedings.

4. When the matter was taken up today, Mr.C.Sathish reports that the petitioner had been terminated from service by the then President of the Panchayat, on 25.04.2013. He has enclosed the resolution of the Panchayat to support the same.

5. The learned counsel for the petitioner states that no show cause notice or enquiry was conducted prior to this order being passed and he has come to know of this order only now.

6. Since an order of termination has been passed, the prayer sought for by the writ petitioner cannot be granted. However, the grievance of the petitioner, that he has not been served with a copy of the order of termination has been redressed, as Mr.C.Sathish, has given a copy of the order to him, today. If the petitioner is still aggrieved, it is open to him to challenge the same in the manner known to law.
