PRAYER:-Writ Petition filed under Article 226 of the Constitution of India, praying for an issuance of Writ of Mandamus, directing the respondents 1 and 2 herein to determine the amount of compensation in terms of Section 19 of the Tamil Nadu State Highways Act, 2001, in lieu of acquisition of the property situated at North Vellore, Vellore Taluk and District comprised in Town Survey No.2108/2A admeasuring to an extent of 364 square meter and refer the dispute to the competent Civil Court in relating to the apportionment of such determined compensation in terms of Section 21 of the above said Act, 2001. ORDER
This writ petition has been filed by the petitioner seeking to direct the respondents 1 and 2 herein to determine the amount of compensation in terms of Section 19 of the Tamil Nadu State Highways Act, 2001, in lieu of acquisition of the property situated at North Vellore, Vellore Taluk and District comprised in Town Survey No.2108/2A admeasuring to an extent of 364 square meter and
refer the dispute to the competent Civil Court in relating to the apportionment of such determined compensation in terms of Section 21 of the above said Act, 2001.
2.Mr.M.R.Gokul Krishnan, learned Additional Government Pleader takes notice on behalf of the respondents 1 to 3. By consent of the parties, the main writ petition is taken up for disposal at the admission stage itself. 3.Learned counsel for the petitioner would submit that the property situated at North Vellore, Vellore Taluk & District comprised in Town Survey No.2108/2A admeasuring to an extent of 364 square meter originally belongs to one N.G.Lakshmana Nadar. The petitioner is one of the legal heirs of the said late N.G.Lakshmana Nadar and becomes the owner of the aforesaid property as per the Will executed by the N.G.Lakshmana Nadar. The partition suit is also pending before Sub-Court, Vellore. While so, the aforesaid property was rd respondent Department. Since the 4 th respondent claiming acquired by the 3 himself as one of the co-sharers of the property and raised an objection to
disburse the compensation amount, the respondents 1 & 2 keeping the compensation amount undetermined and disbursing the same. Hence, the present writ petition has been filed.
4.Learned Additional Government Pleader appearing for the respondents 1 to 3 would submit that already enquiry was conducted in the year 2023 and the award is yet to be passed and seeks eight weeks time to pass the award. 5.Heard the learned counsel for the petitioner as well as the learned Additional Government Pleader appearing for the respondents 1 to 3 and perused the materials available on record.
6.Considering the submissions made by either parties, this Court is of the view that since the enquiry was conducted in the year 2023 regarding the rights the 4 th respondent, who made an objection for disbursement of compensation, the respondents 1 and 2 is directed to complete the enquiry and determine the award after issuing due notice to the petitioner, the 4 th respondent and other
parties concerned, within a period of eight weeks from the date of receipt of a copy of this order.
