registered as Doc.No.2100 of 2019 before SRO Sriperumbudur and quash the same and nullify all other subsequent encumbrances created based on the said Non-Traceable Certificate and consequently direct the respondent Nos.1 and 2 to take necessary criminal action against the 4th respondent within the time it may be stipulated by this Court.

ORDER
This Writ Petition (Criminal) has been filed challenging the order dated 29.05.2025 passed by the second respondent.

Heard the learned counsel appearing on either side and perused the materials available on record.

The case of the petitioner is that he had advanced a loan to the fourth respondent by obtaining the title deeds of the immovable property as security by way of mortgage. According to the petitioner, suppressing the said fact, the fourth respondent lodged a complaint before the second respondent alleging that the original title deeds were missing and based on the said complaint, obtained a Non-Traceable Certificate. On the strength of the
Non-Traceable Certificate, the fourth respondent sold the property in favour of the fifth respondent.

The learned counsel appearing for the petitioner also produced certain title deeds which were produced by the fourth respondent, while borrowing the loan. However, the fourth respondent has already executed a sale deed in favour of the fifth respondent. That apart, the alleged mortgage deed is an unregistered document. Now, the property has been sold in favour of the fifth respondent.

Therefore, the petitioner ought to have approached the Civil Court seeking appropriate relief, including challenging the sale deed executed by the fourth respondent in favour of the fifth respondent. Since the Non-Traceable Certificate issued by the second respondent has already been acted upon, no useful purpose would be served by interfering with the same at this stage. Therefore, this Court finds no infirmity or illegality in the Non-Traceable Certificate issued by the second respondent.

Accordingly, this Writ Petition (Criminal) stands dismissed. The petitioner can very well challenge the sale deed executed by the fourth respondent in favour of the fifth respondent in the manner known to law. If the petitioner lodged any complaint with regard to the alleged acts of the fourth
respondent, the third respondent is directed to proceed with the same in accordance with law. Consequently, connected miscellaneous petition is closed. No costs.
