PRAYER : Writ Petition (Criminal) is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus or direction in the nature of writ, to direct the first respondent to constitute a Special Investigation Team (SIT) to look into the allegation by considering the representation of the petitioner dated 11.10.2025, in accordance with law. The present Writ Petition (Criminal) has been filed seeking a direction to the first respondent to constitute a Special Investigation Team (SIT) to look into the petitioner's allegation, by considering his representation dated 11.10.2025.

It is the case of the petitioner that he, who is a senior citizen, had purchased a car with financial assistance from the fourth respondent, 2/7
Kotak Mahindra Bank. The petitioner failed to pay one month's instalment during May 2025 and consequently, the fourth respondent seized the car and had parked it in a yard at Trichy. Subsequently, when the petitioner contacted the fourth respondent seeking return of his car, he was informed that the vehicle had been sold to a third party in Pollachi. On verification, the petitioner found that the car had been sold by the fourth respondent by fabricating documents. Therefore, the petitioner sent a representation dated 11.10.2025 to the first respondent seeking an enquiry into the matter and constitution of a special team. Since the petitioner's representation has not been considered so far, the present petition has been filed. 3.
Learned Government Advocate (Criminal Side) submitted that admittedly, there was a contract between the petitioner and the fourth respondent, who had financed the petitioner and it is also admitted that the petitioner failed to pay the due amount. He further submitted that the representation sent by the petitioner has been forwarded to the Superintendent of Police, Perambalur, in RC.No. C1(3)/527/E3/7
11975034/2025, dated 02.11.2025 for taking appropriate action 4.
Heard both sides and perused the materials available on record.

In view of the above facts and circumstances of the case and taking into account the submissions made by the learned counsel on either side, this Court directs the Superintendent of Police, Perambalur, to conduct an enquiry into the matter and dispose of the petitioner's representation dated 11.10.2025, in accordance with law, within a period of four weeks from the date of receipt of a copy of this order. 6.
With the above directions, this Writ Petition (Criminal) stands disposed of. No costs.
