ORDER

The petitioner, who was arrested and remanded to judicial custody on 01.08.2025 for the offences punishable under Sections 120(b), 395 of IPC and Section 174 (C) of Indian Railways Act, in Crime No. 250 of 2016, on the file of the respondent Police, seeks bail.

The allegation against the petitioner is that the petitioner was also arrested and released on bail and subsequently, he has not appeared before the Trial Court and hence, NBW was issued against him on 13.09.2024 and thereafter, on 27.09.2024, declared that the petitioner as "proclamation offender" by the trial Court and he was arrested on 08.10.2025.

3. The learned Counsel for the petitioner submits that the petitioner was unable to appear before the trial Court due to his prolonged illness and he is ready to abide by any condition imposed by this Court. Hence, he prays bail to the petitioner.

4.The learned Government Advocate (Criminal Side) appearing for the respondent police reiterated the prosecution case and submits that the petitioner is hailing from Maharashtra and earlier he was arrested and released on bail and NBW was also issued in the month of September, 2024 and further, he has not appeared before the trial Court and steps were taken to declare the petitioner as "proclamation offender". After completion of all formalities, he was arrested on 08.10.2025 and further, the case was posted for framing of charges on 04.12.2025. If bail is granted to the petitioner he would abscond and hamper the witnesses. He opposed for grant of bail to the petitioner.

I have also gone through the order in Crl.M.P.No.1350 of 2025 in S.C.No.72 of 2025 passed by the learned District and Sessions Judge, Tirupattur, and it is recorded that the petitioner was absconded for a longer period and the case was split up against the petitioner herein and only thereafter, the petitioner is ranked as A2 in this case. Since the case has been pending for framing of charges and the trial process is also started, I am not inclined to grant bail to the petitioner at this stage.

6. Accordingly, the Criminal Original Petition stands dismissed. 02.12.2025 3/5
