Prayer:

Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus directing the respondents to pay the remaining compensation payable to the petitioner as per the order dated 01.04.1998 passed in L.A.O.P.No.644/1996 on the file of the Learned Sub Court, Hosur and based on the petitioner's representation dated 05.11.2024.

ORDER

The relief sought in this writ petition is to direct the respondents to pay the remaining compensation payable to the petitioner as per the order dated 01.04.1998 passed in L.A.O.P.No.644/1996 on the file of the Learned Sub Court, Hosur and based on the petitioner's representation dated 05.11.2024.

2. Mr.G.Velu, learned Additional Government Pleader takes notice on behalf of the respondents 1 & 4. Mr.S.Ramachandran, learned Standing Counsel takes notice on behalf of respondents 2 & 3. By consent of both the parties, this writ petition is taken up for disposal at the stage of admission itself.

3. The case of the petitioner is that the petitioner's late father owned lands to an extent of 1.09 Acres, comprised in S.No.571/1A, situated at Hosur Village & Taluk, Krishnagiri District. The said land was acquired by the Government and award was fixed at Rs.89,300/- per acre. Due to the objections raised by the land owners, the said amount was enhanced from Rs.89,300/- per acre to Rs.7,62,300/- by the Sub Court, Hosur in L.A.O.P.No.644/1996 dated 01.04.1998. As per the order of enhancement, the petitioner is entitled to a sum of Rs.12,18,016/- along with an interest of 9% for a period of 1 year from the date of acquisition i.e., 05.08.1994 and thereafter an interest of 15% till the date of realization. Accordingly, the petitioner is entitled to receive a sum of 3/6

Rs.50,23,245/- as compensation. However, the respondents have deposited only a sum of Rs.31,15,363/- and failed to deposit the remaining compensation amount. In this regard, the petitioner has sent a representation dated 05.11.2024 to the respondents. But, the said representation was not considered, as on date. Hence, the petitioner has come forward with the present writ petition.

4. Though many grounds have been raised in this writ petition, learned counsel for the petitioner submitted that, it would suffice, if this Court issues direction to the respondents to consider the petitioner's representation dated 05.11.2024.

5. Learned Additional Government Pleader appearing for the respondents 1 & 4 submitted that the petitioner's representation dated 05.11.2024 would be considered and appropriate orders passed, within a time frame that may be fixed by this Court.

6. Heard the learned counsel on either side and perused the 4/6

materials available on record.

Considering the limited relief sought by the learned counsel for the petitioner, this Court without going into the merits of the case, directs the respondents to consider the petitioner's representation dated 05.11.2024 and pass appropriate orders on merits and in accordance with law, within a period of six weeks from the date of receipt of a copy of this order.

With the aforesaid direction, this writ petition stands disposed of. No costs.
