Respondents Writ Petition filed under Article 226 of the Constitution of India seeking issuance of a Writ of Certiorarified Mandamus calling for the records relating to the impugned order made in File No.2025/0103/12 /736337 dated 25.08.2025 passed by the 2nd respondent, quash the same and consequently direct the respondents to transfer the patta No.362 for the lands measuring 50 cents in S.F.No.347/16 Vadambacherri Village, Sulur Taluk, Coimbatore District by considering petitioner's online application dated 25.08.2025 and the sale deed dated 19.01.1998 (Doc. No 67/ 1998 - SRo, Palladam).

ORDER
This writ petition has been filed challenging the proceedings of the second respondent dated 25.08.2025 and for a consequential direction to respondents to transfer the patta with respect to the subject property in the name of the petitioner based on the online application submitted by the petitioner on 25.08.2025.
2. Heard Mr.N.Manoharan, learned counsel for petitioner and Mr.D.Ravichander, learned Special Government Pleader appearing for respondents.
3. The case of the petitioner is that the petitioner had purchased the subject property by virtue of a sale deed dated 19.01.1998 registered as document No.67/1998. The patta also stood in the name of the vendor viz., Pongiyan in Patta No.362, which was issued by the first respondent. After the demise of the petitioner's father, the property was inherited by the petitioner. The petitioner submitted an application seeking patta in her name with respect to the subject property. The grievance of the petitioner is that an online rejection order came to be passed on 25.08.2025 stating that the subject property has been classified as 'Panjami Land' and therefore, the request made by the petitioner cannot 2/4
be considered. Aggrieved by the same, the present writ petition has been filed.

In the considered view of this Court, if the second respondent was not inclined to issue patta in the name of the petitioner due to any reasons, the petitioner ought to have been called for enquiry and necessary clarification must have been obtained from the petitioner. Without doing so, the online rejection order has been straightaway passed and the same is in violation of principles of natural justice.
5. In view of the above, the online rejection order passed by the second respondent is liable to be set aside by this Court. Accordingly, the online rejection order passed by the second respondent dated 25.08.2025 is set aside. The matter is remanded to the file of the second respondent and the second respondent is directed to afford an opportunity to the petitioner and thereafter, pass orders on merits and in accordance with law. The said process shall be completed within a period of six (6) weeks from the date of receipt of a copy of this order. N.ANAND VENKATESH, J.
