O R D E R

This writ petition has been filed challenging the impugned online rejection order passed by the respondent dated 14.08.2025 and for a consequential direction to the respondent to issue patta in the name of the petitioner with respect to the subject property.

2. Heard both sides and perused the materials available on record.

3. The case of the petitioner is that the subject property was initially owned by his grandfather. He claimed his title through a Settlement Deed dated 15.07.1955. On the demise of the petitioner's grandfather on 30.08.1980 intestate, the property was succeeded by the petitioner, his father and two others. Since there was a dispute between the parties, a partition suit came to be filed in O.S.No.80 of 2018 before the Sub Court, Bhavani. Ultimately, the matter was referred to the Lok Adalat and an Award came to be passed on 27.08.2018. The Lok Adalat Award was also registered as document No.2321/2024.

4. The petitioner, thereafter, submitted an application seeking for issuance of patta in his name, in line with the Lok Adalat Award. The same has been rejected 2/4

through the online rejection order dated 14.08.2025 and aggrieved by the same, the present writ petition has been filed before this Court.

5. In the considered view of this Court, the online rejection order is in violation of the Principles of Natural Justice. The petitioner is specifically relying upon the Lok Adalat Award and the allotment made in favour of the petitioner under that award. If the respondent required any clarification, the respondent ought to have called the petitioner for an enquiry. Instead, an online rejection order has been passed, as if there is a dispute pending between the parties. Such online rejection order is unsustainable and the same is set aside.

In the result, this writ petition is allowed and the matter is remanded back to the file of the respondent and the respondent is directed to call the petitioner for enquiry and collect relevant documents from the petitioner and thereafter, pass appropriate orders, within a period of four weeks from the date of receipt of a copy of this order.
