The petitioner, who was arrested and remanded to judicial custody on 06.09.2025, for the offence punishable under Sections 65(2)(m), 65(1), 351(2) of BNS and Section 5(i), 5(j)(ii) read with Section 6(1) of POCSO Act, 2012 in Crime No.118 of 2025, registered on the file of the respondent, seeks bail.

2. The allegation against the petitioner is that the petitioner is running petty shop in a village where the defacto complainant and her daughter were residing and taking advantage of their loneliness, petitioner threatened the victim girl to cooperate with his ill-intention and also committed penetrative sexual assault, due to which, she became pregnant. Hence, the case.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. Hence, he prayed for grant of bail to the petitioner.

4. The learned Government Advocate (Crl. Side) submitted that, DNA report yet to be received and investigation is not completed and opposed to grant bail and he also produced the statement of the victim girl.

5. Considering the gravity of the offence committed by the petitioner as against the victim girl and the fact that the investigation is pending, this Court is not inclined to grant bail to the petitioner. 2/4
